Abstract

The forum bar to extradition was brought into law in October 2013. It was thought it would act to protect persons from extradition where their alleged criminal acts took place in the UK and their connections with the country were such that rendition would not be in the interests of justice. This has generally not turned out to be the case. Accordingly, the question arises whether the forum bar should be amended. The answer is no. Decisions on the locus of criminal proceedings are best taken by prosecution authorities. The point is clearly illustrated by the case of Mike Lynch.
