Abstract

In the process of resolving overcapacity, the labor relations problems caused by unemployment and benefits reduction are likely to lead to dissatisfaction and labor conflicts. This paper empirically studied the selection preference of workers’ right protection in overcapacity company by constructing binary logistic regression model and explored the role of unions and enterprise labor dispute mediation committee in alleviating collective action. It is found that, among these five different types of action, consulting with the boss, asking for help from the union, seeking help from the human resources department,bring to court and the collective action, workers’ right protection selections are influenced by factors such as the extent of benefit damages, personal skill, employees type, enterprise nature and historical memory. The effective enterprise labor dispute mediation committee is helpful to alleviate the collective action but the effective labor union is not effective in moderating workers’ tendency to participate in collective action. Finally, this paper proposed some countermeasures and suggestions for the resettlement of the affected workers, including the trade unions should play the role of representative, encouraging enterprises to explore more internal communication ways and creating more resettlement channels, etc
