The Prevention Effect of the Trade Union on Collective Disputes in Overcapacity Company——A Dual-Route Perspective of Democratic Participation and Human Capital Promotion

Abstract
Based on the employees survey data of 67 overcapacity enterprises in 12 provinces,this paper empirically studies the prevention effect of the trade union on collective disputes.It shows that,in overcapacity enterprises,the trade union,through increasing the degree of democratic participation as well as improving the level of human capital,has beneficial effects on alleviating the collective action.However,the mechanism of above dual routes in moderating workers’ tendency to participate in collective action is adverse.To specific,the democratic participation focus on collective labor rights,while the human capital promotion concentrates on enhancing the employment confidence of employees and protecting personal rights.Meanwhile,this paper proposes some countermeasures and suggestions for avoiding the risks of collective labor disputes,such as strengthening the role of trade unions in safeguarding the rights and interests of workers,attaching importance to constructions of democratic participation system,like workers’ congress,and increasing particular training on workers who are temporarily lose jobs because of overcapacity activities,etc.
