Abstract

This article proposes to analyze Peruvian regulations regarding migrant trafficking from a human rights perspective. Due to the multiple aspects of the issue and the obligations of International Law, the State has progressively adopted a set of norms to address this problem. This regulatory framework faces a series of challenges, firstly, it responds to a little-known reality, due to the lack of reliable data on traffic; secondly, it overlaps at every moment with human trafficking, which results in an invisibilization of trafficking; and thirdly, it fails to understand trafficking as a human rights problem for migrants.
